China is now the world’s largest oil consumer and importer. While this gives the country significant clout in the global oil market, its weight is compounded by the fact that in 2013 it was also the world’s fourth largest oil producer – after Saudi Arabia, the USA, and Russia. China’s oil sector has been dominated by three large state-owned oil companies who have been developing the country’s domestic reserves, building and operating pipelines, managing China’s increasingly sophisticated downstream, and filling its strategic petroleum reserves (SPR)

One of essential terms for validity of contracts is the certainty of price in both Iranian law and jurisprudence

In a valid contract, the price must be known and definite according to articles 190, 216, 339 and 342 of Iran’s civil law and also on the basis of famous verdict of Imamieh jurists.

However, today in international trade law, and particularly in oil and gas contracts, parties concluding contracts which the price remains uncertain

Instead, they hinge it to an index or even in certain cases they keep the price silent.

This type of contracts is called open- price contracts in which price is floating in time and its amount may entail some changes during contract’s life

This article explains this type of contracts from both legal and jurisprudential perspectives
